POSITIVE 2A STORIES: The Big One's Almost Here
Eleven days, patriots. The 41st Annual Gun Rights Policy Conference hits the Westin DFW Airport September 25-27, and the final agenda reads like a freedom festival lineup: keynote by Judge Roger T. Benitez (Ret.) - yes, Saint Benitez himself, the judge who spent a decade making California read the Constitution out loud - plus ATF Director Robert Cekada, Dana Loesch, and half the people who've been winning the court fights you read about here every week. The AMM-Con media event kicks it off Friday the 25th, and registration is still open (SAF, Sept 3). If you can get to Texas, go. If you can't, we'll be covering it from the loading bench.
And because ordinary Americans keep proving the point: on Labor Day in Jefferson County, Alabama, a homeowner confronted two men breaking into his house, they refused to leave, and one shot later they were running - straight into handcuffs. Burglary charges for them; no charges for him (The Armed Citizen, Sept 11, via WBRC). That's how it's supposed to work.
One more for the "told you so" file: a new study covered this week found safe-storage mandates don't measurably work - but education does (Bearing Arms, Sept 14). Train your people. Teach your kids. Freedom plus competence beats mandates every time.
2A WINS
Delaware just got schooled on the oldest American tradition there is. On Sept. 11, U.S. District Judge Maryellen Noreika struck down Delaware's bans on possessing unserialized firearms and on building your own - facially unconstitutional, permanent injunction, courtesy of a Firearms Policy Coalition challenge (Bearing Arms, Sept 11). Americans were hand-building rifles before there was an America. Note the fine print: the CAD-file ban and the unfinished-frame sales ban survived, and the state may appeal.
Maryland: carry wins a seat in the synagogue. Judge Deborah Chasanow enjoined Montgomery County's house-of-worship carry ban after Rabbi J. Menashe Shapiro of Silver Spring Jewish Center challenged it - the county's stack of 1870s-era "historical analogues" didn't hold up (Bearing Arms, Sept 11). The buffer-zone claims didn't win - yet - and DOJ's own suit against the county's gun-free-zone maze is still rolling.
Missouri goes on offense. AG Catherine Hanaway sued ATF in the Eastern District of Missouri, arguing that once Congress zeroed out the NFA tax, the constitutional basis for suppressor and SBR registration dissolved with it (Bearing Arms, Sept 10). This is the suppressor endgame, filed on state letterhead.
Bonus round: DOJ turned its attention to San Jose's sky-high carry-permit fees (Bearing Arms, Sept 10). Rights you have to rent aren't rights.
2A ISSUES / THREATS
Texas, look alive. Gubernatorial candidate James Talarico said a gun and magazine ban is "absolutely" on the table if he's elected (Bearing Arms, Sept 10). In Texas. We punch at policies here, so here's the punch: a ban on the most commonly owned rifles in America is a policy with a Dec. 2 date with the Supreme Court, and it polls worse in Texas than warm beer.
Colorado's SB25-003 is working exactly as designed - which is the problem: the permit-to-purchase scheme is functionally choking off legal AR-15 sales (Bearing Arms, Sept 11).
California watch: still no public sign/veto announcement on the six-pack (AB 1753, AB 1974, AB 2047, SB 948, SB 1220, AB 1743) as of press time (NRA-ILA, Sept 1).
2A DEBATES
The Viramontes amicus wave is rolling. Ahead of the Dec. 2 SCOTUS arguments on AR-15 bans, pro-2A groups filed a stack of merits briefs this week - including one aimed squarely at the gun-control lobby's likely "regulate-instead-of-ban" fallback (Bearing Arms, Sept 12; Sept 9).
ATF finally put suppressor guidance in writing - just not THE guidance. The new open letter to FFLs says repairing a registered can or changing its caliber isn't a "new making" under the NFA. Useful. But it's silent on the question every buyer's actually asking post-injunction: registration status (Bearing Arms, Sept 11). Half a page is not a policy, gentlemen.
Also on watch: Massachusetts' SJC takes up the "suitability" standard (Bearing Arms, Sept 13); non-residents are challenging NYC's one-gun carry limit (Bearing Arms, Sept 13); and Judge Kane's ruling on Colorado's 3-day waiting period is still pending after the Aug. 24 arguments (Colorado Springs Gazette).
